The NBA legend Tells Court He ‘Wasn’t Afraid’ of the Racing Body in Legal Battle
The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, stated that his drive to win and novelty within the sport motivated his push for 23XI Racing to confront Nascar over alleged violations of competition laws.
Financial Stakes and a Will to Win
The owner disclosed financial and corporate details of his 23XI team, revealing he put in $40 million of his personal wealth into the Nascar Cup series team co-founded with partner Polk and longtime driver Denny Hamlin.
“Someone had to step forward,” Jordan said in the Charlotte courtroom. “I was a new person, I had no fear. I believed I could take on Nascar as a whole. From my perspective, the sport required examination through a new lens.”
Central Issue: Franchise System and Renewal Demands
The heart of the case involves the expiration of a 2016 agreement where Nascar granted each team a “charter”. The concept is similar to other professional sports with separately owned franchises, like the NBA’s Hornets or the Carolina Panthers. The agreement was due to end in 2024 when Nascar demanded charter membership renewals.
Jordan was on the witness stand for an hour and left the court to pandemonium, with onlookers and reporters vying for a view or a picture of the global icon.
Spearheading the Fight
23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to overhaul a operating model Jordan contended is breaking the law to maintain excessive control.
At issue for Jordan and Heather Gibbs, who preceded Jordan, are events from last September. Gibbs described a frantic and emotional six hours where the sanctioning body informed teams they had to sign a charter agreement extension. The document spanned 112 pages detailing team compensation and a guaranteed spot in every race.
Choosing Litigation
Jordan said that 23XI and Front Row Motorsports concluded their sole viable path was to refuse a signature that extensive document and litigate the matter. The other 13 organizations agreed to the terms.
The team owners approached Nascar about potential amendments or extension options. Nascar refused to engage, Jordan said.
The Ultimate Motivation: Victory
Ultimately, the pushback against what he saw as a unsustainable system was mostly about the usual bottom line for Jordan: Winning.
“Hamlin persuaded me getting a third driver improved our chances to win,” he said, sharing that he purchased another franchise last year for $28m despite the uncertainty. “So I took the plunge.”
Heather Gibbs’ Testimony
Heather Gibbs detailed her push for indefinite franchises, submitted in a written letter to Nascar. She testified the timing of the contract signing demand was problematic.
She said, the team founder first tried to call and talk Nascar out of demanding signatures, but Nascar’s leader declined the request.
“Don’t do this to us,” Gibbs recounted was the message to Nascar’s executives. She said France replied, “If I wake up and I have 20 charters, I have 20. If there are 30, I have 30.”
