US Judge Orders Freedom of Kilmar Abrego Garcia from ICE Custody
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks legal authority.
"Since his release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.
The case originates in a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an error. After his repatriation to the United States to answer human smuggling charges, he was held in immigration detention.
In her order, the judge noted that the government does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
Context of the Case
The legal proceedings center on conflicting assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.
He has also entered a not guilty plea to the conspiracy counts, which are part of a ongoing trial in Tennessee.
Conditions of Freedom
The court, who was hearing his petition to deportation in a Maryland district court, determined that he must now adhere to the conditions of his release from custody in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.
This decision marks a notable turn in a complicated legal case involving allegations of mistaken imprisonment and disputed criminal affiliations.
